Terms of Service

Mimicly is a creative mockup editor for making app-style scenes, chat screenshots, social posts, story frames, and UI examples for storytelling, parody, design previews, education, and content creation. These Terms of Service (the "Terms") are a binding agreement between you and the operator of Mimicly ("Mimicly", "we", "us"). By creating an account, installing the app, or using Mimicly, you confirm that you are at least the age of digital consent in your country and that you agree to these Terms, our Privacy Policy, and the Acceptable Use rules below. If you do not agree, do not use Mimicly.

What Mimicly is (and is not)

Mimicly produces fictional, user-created mockups. It does not send messages, post to any platform, access any third-party account, or generate genuine records from any service. Anything you make in Mimicly is a simulated image that you author and control. Mimicly is a creative and design tool, not a means to create authentic communications, official documents, or evidence.

Your responsibility for what you create and export

You are solely responsible for the content you create, edit, save, export, download, and share, and for how you and anyone you share it with use it. You decide what text, names, images, and likenesses to put into a mockup, and you bear full responsibility for those choices and their consequences. You represent and warrant that:

  • you have all rights and permissions needed for any name, photo, logo, likeness, or other material you input;
  • your use of Mimicly and your exports comply with all applicable laws and the rules of any platform where you share them;
  • you will not present a Mimicly export as a genuine message, transaction, document, or record in order to deceive any person, business, court, employer, or authority;
  • where a mockup could reasonably be mistaken for something real, you will clearly identify it as a mockup or fictional content.

You accept all risk arising from your content and its use. Mimicly has no control over, and accepts no responsibility for, what you produce or how it is used or interpreted by others.

Acceptable Use

You agree that you will not use Mimicly, and will not use any export from Mimicly, to:

  • commit or facilitate fraud, scams, phishing, blackmail, extortion, or theft of money, property, or benefits;
  • fabricate evidence or create fake records to mislead a court, employer, landlord, insurer, government body, or any other person or institution;
  • impersonate, defame, harass, threaten, bully, stalk, or invade the privacy of any real person or organization;
  • create sexual content involving minors, non-consensual intimate content, or content that sexualizes a real identifiable person without consent;
  • produce hateful, violent, or unlawful content, or content that incites harm;
  • infringe anyone's intellectual property, publicity, or privacy rights;
  • violate the terms, policies, or trademarks of any third-party platform; or
  • do anything otherwise illegal where you live or where the content is used.

We may remove content, suspend, or terminate accounts that we reasonably believe violate these rules, with or without notice. You are responsible for your conduct even after your account ends.

Third-party brands, trademarks, and no affiliation

Mimicly is an independent product and is not affiliated with, endorsed by, sponsored by, or connected to any third-party platform, application, company, or game. Template styles may resemble well-known apps so you can describe the look you want. All third-party names, logos, trademarks, and trade dress are the property of their respective owners and are referenced only descriptively (nominative use) to identify a mockup style. No ownership, partnership, or approval is claimed or implied. If you are a rights holder and believe a template infringes your rights, contact us using the IP / takedown details below and we will review it promptly and in good faith.

Intellectual property and takedown (DMCA)

You keep ownership of the original content you create. We retain all rights in the Mimicly app, brand, software, and templates. To report content you believe infringes your copyright or trademark, email info@mimicly.net with: identification of the work, the material or template at issue, your contact details, a good-faith statement, and a statement under penalty of perjury that you are authorized to act. We respond to valid notices and will remove or disable access to infringing material where appropriate, and may terminate repeat infringers.

Accounts

Keep your login secure and use an email address you can access. You are responsible for all activity under your account. You can delete your account at any time from the profile page (see Account Deletion).

License to use Mimicly

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Mimicly for your own lawful mockup and content-creation purposes. You may not copy, resell, reverse engineer, or misuse the app, scrape it, or use it to build a competing service.

Plans and billing

  • Free includes a limited template and export set, with a Mimicly watermark on Pro-template previews.
  • Pro Monthly is $5.99 per month during launch discount pricing, shown against a $9.99 regular price.
  • Pro Lifetime is $12.99 during launch discount pricing, shown against a $17.99 regular price.

Web checkout is processed by Lemon Squeezy. Native app purchases are processed by Apple or Google under their terms. Monthly plans renew until canceled. Lifetime means access for the operating life of the Mimicly service under your account. Refund handling is described in the Refund Policy.

Availability and changes

We work to keep Mimicly available, but the service may change, pause, or have outages, and we may add, remove, or update templates and features at any time. We may update these Terms; material changes will be reflected by the "Last updated" date, and continued use after an update means you accept the revised Terms.

Disclaimer of warranties

Mimicly is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that any export is suitable for any particular use.

Limitation of liability

To the maximum extent permitted by law, Mimicly and its operators will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or reputation, arising out of or relating to your use of Mimicly or any content you create or export, even if advised of the possibility. To the maximum extent permitted by law, our total aggregate liability for any claim relating to Mimicly will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 50. Nothing in these Terms limits liability that cannot be limited under applicable law, and mandatory consumer rights still apply where local law requires them.

Indemnification

You agree to defend, indemnify, and hold harmless Mimicly and its operators, affiliates, and personnel from and against any claims, demands, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) the content you create, export, or share; (b) your use or misuse of Mimicly; (c) your violation of these Terms or any law; or (d) your violation of the rights of any third party, including intellectual property, publicity, and privacy rights.

Termination

You may stop using Mimicly and delete your account at any time. We may suspend or terminate access if you breach these Terms or use Mimicly unlawfully. Sections that by their nature should survive termination (including your responsibility for content, disclaimers, limitation of liability, and indemnification) will survive.

Governing law and disputes

These Terms are governed by the laws of the operator's principal place of business, without regard to conflict of law rules, and you and we submit to the courts located there, except where mandatory local consumer law gives you other rights. The specific governing jurisdiction and venue are set by the operator at info@mimicly.net and may be requested at any time.
